Who is responsible for processing your personal data?

Marcos Perez Vilarrubi | Filmmaker | Brand & Marketing Strategist (tax ID NIF 44024982S) (hereinafter, the DATA CONTROLLER) is responsible for processing the USER’S personal data and informs you that such data will be processed in accordance with Regulation (EU) 2016/679 of 27 April 2016 (General Data Protection Regulation, GDPR) and Spanish Organic Law 3/2018 of 5 December on Personal Data Protection and the Guarantee of Digital Rights (LOPDGDD).

Why do we process your personal data?

Depending on the form through which we collect your personal data, we will process your information confidentially for the following purposes:

Contact Form

• To respond to enquiries, requests for information, or any other communication submitted through the contact methods available on our website.

• To send marketing communications by email, SMS, social media, or any other current or future electronic or physical means regarding our products, services, or those of our trusted business partners with whom we have established promotional agreements. • To prepare and send quotations relating to our products and services.

Clients and contract management

• To manage the contractual relationship with companies, self-employed persons and professionals: accepted quotes, delivery of the service, invoicing and collection.

• To process the contact details of the people who represent or act on behalf of client companies.

Careers / Job Application Form

• To include applicants in recruitment and personnel selection processes and evaluate their professional profile in order to identify the most suitable candidates for available positions.

How long will we retain your personal data?

Your personal data will be retained only for as long as necessary to fulfil the purposes for which it was collected, or for as long as required by applicable legal obligations. Once the retention period has expired, your data will be securely deleted or anonymised using appropriate technical and organisational measures. Specifically:

• Original files delivered to clients: 30 days from delivery, or until an open claim is resolved.
• Invoices and accounting records: for the legal periods (up to 6 years).
• Client data: during the contractual relationship and for as long as liabilities may arise.
• Contact forms and quotes not accepted: up to 12 months without a reply from the data subject, or until consent is withdrawn.
• Newsletter: until the data subject unsubscribes.
• Job applications: up to 12 months.

Who do we disclose your personal data to?

Your personal data will not be disclosed to third parties except where necessary for the provision of our services or where we are legally required to do so.

Where required, your information may be shared with service providers acting as data processors on our behalf (web hosting, email, analytics, invoicing and communications). These providers are contractually bound by confidentiality obligations and comply with the requirements established by the GDPR. Data may also be shared with public authorities where there is a legal obligation.

Some of these providers (for example, Google, YouTube or Meta) may process data outside the European Economic Area. In those cases, the safeguards provided by the GDPR apply, such as adequacy decisions or standard contractual clauses.

Images of people in video and photography services

In the services provided to companies, self-employed persons and professionals, the client decides how the material is used and is responsible for informing the people who appear in it and for obtaining the authorisations required by law, including those of the venue and the event organiser. The DATA CONTROLLER only captures the images on the client’s instructions and acts as data processor to provide the service and deliver the material. For its portfolio, the DATA CONTROLLER acts as data controller (on the basis of legitimate interest and, where the person is identifiable, their consent) and only publishes images of identifiable people when they have authorised that use or when their appearance is merely incidental; otherwise, it blurs or omits them. If you appear in an image and wish to exercise your rights, write to marcosperez@creadordecontenidougc.es. We will remove or blur the image from the portfolio as soon as possible.

Your Rights

As a data subject, you have the right to:

• Withdraw your consent at any time.
• Request access to your personal data.
• Request the correction of inaccurate or incomplete personal data.
• Request the deletion of your personal data (“right to be forgotten”).
• Request restriction of processing under certain circumstances.
• Object to the processing of your personal data.
• Receive your personal data in a structured, commonly used and machine-readable format (data portability).
• Lodge a complaint with the Spanish Data Protection Agency (AEPD) if you believe that the processing of your personal data does not comply with applicable legislation.
